I have an idea, and I’m working on it.

[Nile] Mmhmm.

[uneasy music playing]

Your fingerprint’s the only one on this.

So either you take the fall for all of us, or we all fall together.

Which means you have a choice to make.

But you’ll be well compensated.

Ten times your annual pay for every year you serve.

Plus a point in Jarvis Yards.

Generational wealth, Nick.

You turn yourself in, take a plea.

You’re looking at 18 months out of three years, max.

That’s longer than my marriage, and that felt like a lifetime.

[music subsides]

Here you go.

[man] All right. [sighs]

So I spoke to the DA.

We actually talked for a while.

He’ll drop the criminal negligence charge if Frank pleads guilty to reckless endangerment.

That’s still a felony.

Yes.

Which means prison time.

Given the extent of the victim’s injuries, he says a misdemeanor is out of the question.

Even though Frank has no record, and he’s cooperated?

[man] I’m sorry.

So… that’s it? We’re out of options?

As we discussed, we could take it to trial, make the argument Frank’s working on thin margins and didn’t know the concrete wasn’t up to code.

It was off-market concrete I bought in cash from the back of a truck.

I should’ve asked questions.

[Erika] If we go to trial, what’s your best guess about the outcome?

The victim will likely never walk again, which will play with the jury, so I’d say take the plea and save your money for the civil suit that comes next.

Which will deplete whatever money we have left.

A felony plea does make it more likely that you’ll be found liable, yes.

What if we got divorced?

What?

I mean on paper.

We separate our assets.

I file for Chapter 11.

They can’t come after you, and the kids are protected.

Frank–

Not to mention your career at the Bureau.

A husband in prison, is that… is that really what you want?

[scoffs] I wanna be clear of this.

I want us to be clear of this.

Maybe I don’t deserve to be clear of it.

Or maybe he’s holding something over you.

No one’s threatening me.

I can help you.

No one is paying me.

You don’t have to do this.

I’m telling you the truth!

If the roles were reversed, you think Nile Jarvis…

Nile Jarvis! You think he would take a fall for you?

Hmm?

You think he gives two shits about some sniveling little pissant like you?

You could be the one to make him accountable.

You’re a fucking coward!

Get off of me!

Fuck off.

Let’s go. Take a breath.

You don’t actually believe that shit?

It’s not about what I believe.

It’s about what we can prove.

Now, I just spent three hours with digital forensics going over the financials.

They can’t find anything to connect the payments to Jarvis.

There has to be a way. We are this close.

No, you’ve been this close, Brian, for two years.

The only definitive link is to Ryder, who just gave us a full confession.

And what about my source, huh?

She’s trusted me. She’s risked everything.

This is not over. This…

This can’t be over. I can get him.

You ever read Moby Dick?

Me neither.

But even I know the guy dies chasing the whale.

I’m sorry, Brian.

[pensive music playing]

[sniffles]

[uneasy music playing]

Yeah, it’s me.

Uh, we gotta talk. Not on the phone.

[clears throat]

[children chattering]

[wistful music playing]

Sorry I’m late.

No worries.

She’s tiring herself out out there.

We’ll see you after the holidays.

Yeah. Merry Christmas.

You too.

[uneasy music playing]

Which one’s yours?

Blue coat.

Have we met before?

Don’t think so.

Your husband in construction?

Yeah.

I heard he got himself in a bit of trouble.

You have a nice day.

It’s not right what they’re doing to Frank.

DA wants to make an example of him.

Establish his bona fides.

Rack up some wins.

But what if somebody could give him an opportunity for a bigger win?

Maybe he’d change his mind.

Plead Frank out with a misdemeanor.

You might know my husband, but you don’t know me.

I suggest you be careful with what you say next.

I know what it feels like to be where you are, Agent Breton.

I’m offering you a way out.

I could have you thrown in jail for coming to me with that kind of offer.

Yeah, you could.

But then everybody loses, right?

Especially the guy who got his legs crushed when the building collapsed.

What do you think he gets out of coming after you and Frank?

Once Frank files for bankruptcy, after years of waiting, legal fees, he won’t see a nickel.

What if somebody could offer him real money?

Wouldn’t that be a happier ending for everybody?

What is it you want?

A favor.

If you’re interested, get in touch.

You take care of yourself, Agent Breton.

I thought maybe I was being followed.

By who?

It’s probably in my head.

I ducked into a bookstore and waited.

I can’t keep this up.

Okay.

He knows someone’s talking to you.

He thinks it’s Nina.

How close are you to arresting him?

What? What’s wrong?

Ryder turned himself in.

He made a full confession.

[Madison] Yeah.

But he’s saying Nile didn’t know about any of it.

Well, that’s absurd.

You have to get him to flip.

Yeah, I tried.

He knows he’s going to prison, but he and Pedro, they’re on the same page.

They’re telling the same story.

[Madison sighs]

So what happens now?

Maybe if you come forward as a witness…

No.

That wasn’t the deal.

There’s nothing for me to say!

I told you everything I know!

Well, then, I think maybe we’re… we’re out of options.

You’re giving up?

Maddie, listen to me.

No, no, no.

My supervisor is pulling the plug.

You can’t.

Without a witness implicating Nile, we don’t have a case.

Jesus Christ.

I was right about the SPV, about the plane.

Now you fed your bosses, Ryder and Pedro, you don’t give a fuck about me?

That is bullshit. Maddie, come on.

You know this is not what I wanted.

You know how badly I wanted to arrest him.

But even if I don’t, you can still leave him, Maddie.

You can leave him.

You think that’s what this is about?

I don’t know. Fuck.

[pensive music playing]

Two years ago, I was working with this new sculptor, Theo.

A kid. Straight out of the National Academy in Oslo.

Nile was jealous. He thought I was sleeping with him. He confronted me.

It was the angriest I’d ever seen him.

I told him we weren’t.

I thought he believed me.

Two weeks later, Theo was stabbed to death outside a bar in Bed-Stuy.

Supposedly, a mugging gone wrong.

And you think Nile…

Maddie, why are you telling me this now?

Because I know I can’t prove it.

And I know how it sounds, but there are others too.

His whole life, people who have gone missing.

What?

A camp counselor when he was 17.

A domestic worker in a hotel in Paris in 2010.

She was murdered on a night Nile was supposed to be in Milan, but he wasn’t.

He was at a different hotel only two blocks away.

Slow down. Slow down.
