Plot: Mickey is taken to meet Ruth. She refuses to testify, saying their investigation is too important. She admits Sam was their informant on Gazarian, and that Gazarian killed Sam for stealing from him. Gazarian’s girlfriend admits the same to Maggie and Cisco, and that Gazarian framed Mickey for the murder in revenge for the loss of his contracting company, but was killed by his family for attracting attention by doing this. Lorna shows Ruth they have Gazarian’s girlfriend and claims she will testify, and the FBI interrupts the trial to ask that she not do so. To compromise, the district attorney offers to drop the charges, but Mickey instead demands Berg give a public statement exonerating him and the arresting officer be investigated, which they agree to. Gazarian’s girlfriend is put into protective custody. That night, Mickey and Maggie share a moment before she and Hayley leave for San Diego. Maggie admits to Hayley she misses her old life. Mickey later encounters a woman who seems to recognize him. She follows him to his car, and they are attacked by one of Gazarian’s killers, but are saved by the FBI. The woman then claims to be his sister, surprising him.

As if I had a choice.

[Ruth] I apologize for the drama.

I had to get to you before you called someone and said something stupid.

Like what? Like my driver was kidnapping me?

You’ll be taken home safely once we’re done. I give you my word.

All because of a bench warrant?

I’m sorry, Agent. That was the only way to get you in court.

I don’t think you get it, Mr. Haller.

I’m not coming to court, and neither is Agent Vasquez.

Yeah, well, the judge will beg to differ.

Someone high up from the Bureau will talk to someone in the state AG’s office, and somebody will make a call.

It’s beyond my pay grade. Do you understand?

The Bureau isn’t going to sink an investigation this big to save one defense lawyer.

So what, you’re just gonna let me go to prison for the rest of my life for a murder you know I didn’t commit?

We wouldn’t be here if you hadn’t insisted on a speedy trial.

We would’ve wrapped up our case. Yours would’ve been thrown out.

Well, I apologize for exercising my constitutional right not to rot in jail until it’s convenient for you.

I didn’t know anything about your case. My hands are tied, Haller.

You threatened me with a misconduct investigation.

Did you forget that part? You could have made that go away.

You did it because you knew what was happening to me was wrong. Simple as that.

It’s not just a one-off scam. It’s happening all over the country.

About a dozen refineries that we know of so far.

Including Biogreen?

The thing is, the scam may play out in different ways, but in the end, it’s always the same.

It’s just like your EPA expert testified.

[pensive music playing]

A truck leaves the refinery loaded with bio fuel for delivery.

[scanner beeps]

See you on the rebound.

[Ruth] The same truck comes back later carrying raw feedstock, and they make this run multiple times a day.

But the contents of the barrels never change.

They just keep running the same cooking grease in and out and changing the labels.

And every time, they bill the government all over again for it.

The players behind the scam are all the same too.

Some of the biggest organized crime groups in America, taking in millions.

That’s where Sam came in.

We needed somebody on the inside, preferably someone with a record that we could turn.

You needed your fingerprints off of it. [music fades]

That’s why you took Sam’s wallet from the morgue. Isn’t it?

You didn’t want anybody connecting him to Biogreen and exposing your investigation.

Sam was supposed to get you to Alex Gazarian.

Gazarian was gonna move you up the food chain, only now they’re both dead.

All the more reason that we can’t compromise this investigation any further.

[tense music playing] Tell that to Sam.

What happened to Sam Scales is unfortunate.

Unfortunate? That’s one way of putting it.

He’s dead. And it’s your fault.

How?

[Mickey] Stop playing dumb.

Gazarian found out Sam was informing on him.

That’s why he took him out.

That’s a plausible theory, but that’s not what happened.

What the hell did happen? Why else did Gazarian kill Sam?

Because…

Sam was stealing from Alex. That’s why Alex had him whacked.

Alex didn’t know anything about the FBI.

[music fades]

Jeez, he would’ve killed Sam sooner if he had.

And… [sighs] …I’m probably next.

Well, I got a crew who can keep you safe for the time being, but who knows?

Maybe the Armenians won’t even bother to come after you.

Seriously? These people just killed a member of their own family.

Think they’re gonna think twice about taking me out?

[Maggie] I can probably get you some kind of protection, but first, I need the truth.

I need to know everything you know. All of it.

But I need you to be honest. You understand?

Did you actually witness Sam’s murder?

[Jeanine] No, nothing like that.

Alex kept me away from the ugly stuff, but.

I know about Biogreen.

He put my name on it so there wouldn’t be a paper trail back to him.

And how did Sam even become involved with Biogreen in the first place?

As pissed off as Alex could get when someone tried to pull one over on him, he also knew good work when he saw it.

Sam tricked him with some art gallery scam a while back.

Yeah, yeah, we are aware of that incident.

[pensive, rhythmic music]

[Jeanine] Well, Alex was impressed in spite of himself, and they connected after that.

Sam had a lot of skills.

Skills Alex figured he could use to run the Biogreen operation.

[Maggie] And by the Biogreen operation, you mean the fraud they were pulling, right?

Yeah, Sam did most of the groundwork.

He even got a truck license to help pull it off, and it worked.

Money was flowing, Alex’s family was happy, which meant Alex was happy.

Let me guess, until he started noticing some money missing?

[Jeanine] Alex couldn’t understand… why the math wasn’t adding up.

[music intensifies]

Then he figured out that Sam set up his own shell company and was taking a cut of the subsidies that were supposed to be going to Alex’s family.

[Maggie] Sam was scamming the scammers.

Classic Sam. Couldn’t help himself.

Yeah, well, neither could Alex.

And you’re positive of this?

When he made us go on the run, I forced him to tell me the truth.

I said to him, I wasn’t gonna go anywhere with him if he didn’t tell me exactly what the hell was going on.

[Maggie] And what did he tell you?

[Jeanine] When he found out that Sam was ripping him off, he lost his shit.

[Sam] Hey.

What, is there a problem? You could say that.

Oh, come on, Alex. Look, look, look.

Whatever it is, we can work it out.

I got the… Oh God!

Relax, very nice.

[music fades]

But how did he end up in the trunk of Mickey Haller’s car?

Alex hated Haller because he pushed him into pleading the Fifth at that chef’s trial.

I mean, he lost the Olympic contract.

He had to sell his construction company.

Otherwise, he never would’ve been running Biogreen at all.

So taking out Sam and pinning it on Mickey solved all of his problems at the same time?

Yeah.

Something like that.

Except I’m betting his family didn’t appreciate the attention that came with it.

So they decided to cauterize that wound.

[Jeanine inhales] [tense music playing]

Dummy never thought things through. [huffs]

[Jeanine sighs]

He never thought that…

[sniffles]

…his family would turn on him.

Fucking idiot.

[horn blaring]

[music fades]

[car starts]

[line ringing]

[phone vibrating]

Mickey, where have you been? It’s a long story.

Agent Ruth wanted to meet. Are you still at the house?

No. Um… Cisco called.

I’m down here in Orange County with him and Jeanine Ferrigno.

[Mickey] I hope she can help because Agent Ruth made it very clear the FBI is not gonna take the stand.

[Maggie] Yeah, she told me everything.

According to her, Gazarian had no idea that Sam was informing to the FBI.

That’s what I heard too.

They killed him because he was skimming off the top.

Legal was right. There really is no honor among thieves.

Doesn’t matter. The thing that matters is getting Jeanine to testify.

She’s the only one who can put this on Gazarian.

Just give me a sec.

She’s never gonna testify, Mickey.

We’ll subpoena her if we have to.

[Maggie] She’ll just lie and say she doesn’t know anything, or she’ll take the Fifth.

She’s on the run from the people who killed her boyfriend.

Think she’s just gonna get up there and name names?

Well, can you get her protection?

I told her I’d try, but… [sighs]

…as a defense attorney, how?

If I was the DA, sure, but

Dana Berg’s not gonna play ball.

Neither are the feds. They don’t want anybody testifying.

All they care about is protecting their case.

They’re not gonna help me.

[intriguing music playing]

Unless we force their hand.

[Lorna] Agent Dawn Ruth?

Yes. I’ll ask again, who is this?

I have a message from Mickey Haller. You should probably look out your window.

[Ruth scoffs]

[Ruth sighs]

Hello, Ms. Crane. Mickey was right.

About what?

Juan really does sell the best paletas.

What do you want?

I think it’s more about what you want, actually, which is to protect your Biogreen case and find somebody who can connect the dots to Alex Gazarian.

Whether in private or, you know, in open court.

If you’re talking about Jeanine Ferrigno, then it’s a good thing you’re here today.

As I’m sure you’re aware, Miss Ferrigno is a person of interest in an ongoing federal investigation.

So I think it’s in everyone’s best interest if you escort her to the Bureau’s lobby ASAP.

Oh, that is not in my best interest or in Mickey’s.

Okay, I know you think you’re helping Mr. Haller, but you’re not.

[Lorna] I know who’s not helping Mr. Haller.

The FBI.

And since that’s the case, he really has no choice but to put Ms. Ferrigno on the stand and hear everything she has to say, and I mean everything.

If I were you, I’d bring popcorn.

Ms. Crane. [line beeps]

Ms. Crane.

[indistinct chattering]

[music fades]

[Lorna breathes deeply]

[door opens]

[bailiff] All rise.

[Stone] Be seated, please.

Does the defense have any more witnesses to call?

Uh…

Yes, yes, Your Honor, we do. [tense music playing]

If, uh…

If the court would allow me just a moment.

[indistinct whispering]

[hushed muttering in courtroom]

[Stone] Mr. Haller?

Perhaps today?

[Mickey clears throat]

Uh, the defense calls…

[breathes deeply]

The… [Maggie sighs]

[indistinct speech]

[sighs] Members of the jury, my sincere apologies for this, uh, unfortunate delay, but the court must take a short recess.

I’ll see counsel in my chambers immediately.

[tense music continues]

[music fades]

[Stone] Ms. Berg, Ms. McPherson, you both obviously know District Attorney Suarez.

[door closes] I assume you do as well, Mr. Haller.

We’ve met.

Can I ask what this is all about, Adam?

[knocking at door] [door opens]

I take it you’re from the FBI.

Yes, Your Honor. Thank you for seeing us on short notice.

I’m Stephen Tremblay, the special agent in charge of the Los Angeles field office, and this is my colleague, Agent Dawn Ruth.

Well, I guess someone touched a nerve somewhere.

Judge, it’s come to our attention that the defense in this trial is about to call a witness, Jeanine Ferrigno, but the information that Ms. Ferrigno might share is extremely sensitive and highly relevant to an ongoing federal investigation, an investigation that would be directly imperiled by this information coming to light.

When Agent Ruth brought this to my attention, I immediately consulted with District Attorney Suarez.

He agreed that Ms. Ferrigno cannot be permitted to testify at this time.

In fact, we believe that Ms. Ferrigno’s life is in danger because of the information she possesses, and accordingly, we have a team of US Marshals prepared to take her into protective custody.

That’s, uh, all very interesting, Agents, but it seems the FBI has a slight problem.

Mr. Suarez doesn’t decide who gets to testify in my courtroom.

I do.

[Suarez clears throat]

Of course, that’s true, Your Honor. [pensive music playing]

But what I can do is offer a resolution to this case, one that will hopefully render Ms. Ferrigno’s testimony… unnecessary.

What do you mean, a resolution?

Having taken the totality of the circumstances into account, my office is prepared to drop the charges against Mr. Haller.

What?

Provided he’s amenable to an agreement, of course.

You’ve gotta be fucking kidding me!

Ms. Berg, you get one warning. This was it.

What kind of agreement?

Well, first of all, we’ll need your silence and cooperation until the federal case is adjudicated.

And when would that be?

Obviously, we can’t say.

So we’re clear, a jury has been impaneled. Jeopardy has attached.

[Suarez] Correct.

Mr. Haller can never be retried.

We will move to dismiss the case with prejudice.

And what would be the basis for this dismissal?

[Suarez] My office will make a statement that we’ve come into possession of new evidence, which casts grave doubt on the validity of the case.

[Dana scoffs quietly]

Happens all the time.

Yeah, sure, happens all the time in cases no one’s paying attention to.

You’re saying you’ll drop the charges, but I can never say why?

No one will ever present this evidence showing I was wrongly accused or apologize or…

[Dana scoffs]

See?

Even now, your prosecutor still thinks I did it.

“If it quacks like a duck…” Dana.

[pensive music continues]

You know what?

I think I’ll pass.

You’d rather take your chances with a verdict?

If taking a deal means I have a cloud over my head for the rest of my life, yes.

I leave my fate in the hands of the jury.

And when I get a “not guilty,” maybe then you can finally accept you got it wrong.

Juries get it wrong all the time.

I can also tell the world how I was set up right under the FBI’s nose and how the DA’s office went right along with it and railroaded me.

So, yeah. I think I like that deal better.

What do you want?

I want the same thing I wanted from the beginning.

The only thing. I want my reputation back.

I want my innocence.

And how do you propose we give you that?

I want a public statement from the DA’s office that completely exonerates me of any crime.

And I want her to deliver it.

She is the one calling me a murderer for the last four months.

She’s the one the world needs to hear it from.

Let’s say, for the sake of argument, we can accommodate that.

Yes. Officer Roy Collins from the LAPD.

He was waiting for me that night. Everyone here knows it.

I was framed for this, and I was stuck in jail and nearly killed while my name was dragged through the mud.

I don’t run the LAPD, Haller.
